Working together
Terms and Conditions
Last updated: 1 November 2026
These terms apply to your use of the Buildx Digital website. Services are provided under a separate written proposal, statement of work, or other agreement where applicable. If that signed agreement conflicts with these general terms, the project agreement controls for that project.
1. About these terms
“Buildx Digital”, “we”, “us”, and “our” refer to the digital services provider operating under the Buildx Digital name in India. “You” or “client” means the person or organisation using this website or engaging our services. Questions may be sent to buildxdigital17@gmail.com.
2. Services and project proposals
We may provide website design and development, e-commerce work, apps, automation, UI/UX design, website redesign, and related support. The written project proposal or agreement should define the actual services, deliverables, exclusions, milestones, schedule, fees, payment dates, and included revision rounds. Work outside that scope requires written approval and may involve additional fees or time.
3. Client responsibilities
You agree to provide accurate information, timely feedback, required approvals, and materials needed for the project. You are responsible for ensuring that text, images, logos, data, and other materials you supply are accurate and that you have the rights and permissions needed for their use. You must keep your account credentials secure and use the delivered work in compliance with applicable law and third-party terms.
4. Fees, payment, and expenses
Fees, payment milestones, taxes, and any approved expenses will be set out in the project proposal or agreement. Unless the project agreement says otherwise, work starts after the scope and payment arrangements have been accepted in writing. If an invoice is overdue, we may pause work after giving reasonable notice. Any applicable taxes will be handled as required by law.
5. Reviews, changes, and delays
Included reviews and revisions are limited to what the project agreement states. New features, significant changes to approved work, or additional deliverables may require a revised quote and schedule. Delivery dates depend on timely client feedback, content, approvals, and third-party services; delays in those dependencies may affect the schedule.
6. Ownership and licences
After full payment of all amounts due for a project, ownership of the final custom deliverables created specifically for that client transfers to the client, except for the items described below and any different written project agreement.
Buildx Digital retains ownership of pre-existing materials, tools, reusable code, methods, know-how, templates, and components that are not unique to the client. Where these are included in a deliverable, we grant the client a licence to use them as part of that deliverable for its intended business purpose. Third-party software, fonts, stock assets, plugins, and platform components remain subject to their own licences and terms.
The client grants Buildx Digital permission to use client-supplied materials only as needed to perform the agreed services. We will not publicly identify the client or display non-public project work in our portfolio without permission.
7. Third-party services and ongoing support
Websites and digital projects may depend on hosting providers, domain registrars, payment processors, plugins, APIs, social networks, or other third parties. Their availability, security, pricing, and terms are outside our control. Unless expressly included in a written agreement, hosting, domain fees, subscriptions, maintenance, and post-launch support are not included in the project fee.
8. Cancellation and termination
Either party may end a project as allowed by its written agreement. If no specific termination terms were agreed, either party may request termination in writing. The client remains responsible for fees for work completed and approved expenses incurred up to the effective termination date. Any handover, refund, or transfer of work will be handled in accordance with the project agreement and applicable law.
9. Warranties and results
We will perform agreed services with reasonable care and skill. Unless a project agreement expressly promises a result, we do not guarantee particular search rankings, sales, leads, revenue, traffic, conversion rates, uninterrupted availability, or compatibility with every third-party service or future update. The client is responsible for reviewing the final work and for business, legal, accessibility, privacy, and regulatory decisions relating to its own operations.
10. Liability
To the maximum extent permitted by applicable law, neither party is liable to the other for indirect or consequential loss arising from a project. To the same extent, Buildx Digital’s total liability for a claim related to a project will not exceed the fees paid or payable for the specific project giving rise to the claim. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.
11. Website use and changes
Website content is provided for general information and may change without notice. You must not misuse the website, attempt unauthorised access, interfere with its operation, or use its content in a way that infringes another person’s rights. We may update these terms by posting a revised version here; the date above shows when this page was last updated.
12. Governing law and disputes
These terms are governed by the laws of India. The parties will first try in good faith to resolve a dispute through direct discussion. If it is not resolved, the dispute may be brought before a court having jurisdiction under applicable Indian law. Nothing in this section limits any non-waivable rights or remedies available under applicable law.
